Britney Spears Skipped Test

Britney Spears lost custody of her children after ex-husband Kevin Federline accused her of failing to take a drugs test.

The 'Toxic' singer, who was ordered by a Los Angeles court to hand over two-year-old Sean Preston and one-year-old Jayden James to Kevin until further notice on Monday (01.10.07), is said to be fuming after Kevin's legal team claimed she had missed a random drug and alcohol test.

Britney's attorney Sorrell Trope told People magazine: "There was a claim by Mr. Federline's attorney that she had not complied with a previous order the court had made - before I came on board as lawyer - about having a random drug and alcohol test.

"There's no evidence that she actually failed a test."

The court treats failure to take a test the same as actually failing a test and has scheduled another hearing for today (03.10.07).

Last month, Judge Scott M. Gordon said Britney showed "a habitual, frequent and continuous use of controlled substances and alcohol" and ordered her to take twice-weekly drug tests.

Federline, who was "thrilled" after receiving temporary custody of his sons, is yet to comment on claims Britney missed a test.

Monday's custody decision was also made because Britney couldn't provide a California driver's licence.

Trope explained: "We weren't able to prove compliance with what the judge ordered.

"Specifically, the judge ordered that by 10am on Monday morning, both parties show valid California driving licences. I've been unable to produce evidence of that."

Britney, whose Louisiana licence is not valid in the state of California where she is currently living, applied for a valid licence soon after handing her sons over to Kevin's bodyguard on Monday.

Last month, the singer was charged with driving without a valid licence and leaving the scene of an accident after she hit another car.

She faces up to six months in jail if found guilty.

Britney and Kevin - whose divorce was finalised in July - had originally been granted joint custody of their sons.

Britney's erratic behaviour - which has seen her indulge in wild partying, allegedly take drugs, publicly shave her head and enter rehab - sparked Kevin's decision to fight to become the boys' primary carer.
